Kathleen Zellner, lawyer for Steven Avery, says she's celebrating a victory after the Wisconsin Court of Appeals ordered Avery's appeal remanded to circuit court.

According to court documents, Avery filed a motion with the Wisconsin Court of Appeals over a 2011 police report that apparently shows law enforcement handed over suspected human bones to Teresa Halbach's family. Avery claims that the State violated his due process rights when they destroyed potential evidence.
In a ruling filed Monday, the court says the appeal is remanded to the circuit court to permit Steven Avery "to pursue a supplemental postconviction motion raising 'claims for relief in connection with the State’s violation of WIS. STAT. § 968.205 and Youngblood v. Arizona.'"
