The Winnebago County District Attorney's Office has determined an Oshkosh officer was justified in his use of deadly force when he shot and killed a man in July.

The DA's office gave that update during a press conference Thursday.

Oshkosh Police officers Aaron Achterberg and Kyle Roberts were involved in the shooting death of 28-year-old Isaiah Tucker, according to the Oshkosh Police Department.

Achterberg fired his gun 11 times during the incident, striking Tucker in the shoulder and knee, the DA said. The gunshot wound in the shoulder ultimately caused his death, he explained.

Tucker was found in a shed in the 800 block of W. 6th Ave after the District Attorney's office said officers shot at him on the 300 block of Knapp Street.

According to Oshkosh Police Chief Smith, police responded to a call from a resident. The caller said a man was trying to take items from his home, along with his car, officers said.

When officers arrived on scene, they saw a vehicle crashed through the door of a garage that was stuck in the yard, according to police.

Chief Smith said an officer tried to remove Tucker when he accelerated toward the other officer, who opened fire.

Tucker fled in the vehicle and was found hiding in a shed, suffering from gunshot wounds.

Both officers were wearing body cameras. The cameras have been turned over to the state Division of Criminal Investigation, which is handling the investigation.

The press conference began at 3 p.m. NBC26 will livestream it here.
