Steven Avery's request to have a substitute judge hear his appeal has been denied.
A Sheboygan County Circuit Court Judge ruled on Monday that his request is "premature".
If Avery's attorneys file their brief by July 7th, the U.S. Court of Appeals will consider reviewing previously undisclosed evidence. Avery's legal team claims that evidence includes a forensic report, thousands of photos, and evidence taken from a computer in the home of Avery's relatives.
Steven Avery, along with his nephew Brendan Dassey, is serving a life sentence in prison for the 2005 murder of Teresa Halbach.
The U.S. Supreme Court just ruled last week that they will not hear Brendan Dassey's appeal.
The case has gained international interest from the Netflix docu-series "Making a Murder".
