Oshkosh officer 'justified' in deadly July shooting

An Oshkosh Police officer's use of deadly force in a July shooting was justified, the Winnebago County District Attorney said Thursday.

Officers Aaron Achterberg and Kyle Roberts were both put on administrative leave after the July 31 shooting that killed 28-year-old Isaiah Tucker. Officer Achterberg fired the shot that ultimately killed Tucker, the DA said.

"We want to protect all lives," said Oshkosh Police Chief Dean Smith. "This shooting is a tragedy. We never want to shoot anyone."

The mother of Tucker's child called police that night saying Tucker was trying to steal her car from her house on the 300 block of Knapp Street, officers said. He had been at her home earlier in the day and stole more than $400, according to police.

Tucker had recently escaped from a closed rehab facility and knew he had a warrant out for his arrest, police said.

When police arrived on scene, officers told Tucker several times to get out of the car and warned him they would shoot, body camera video showed.

Tucker then drove the car out of the garage and towards Officer Achterberg, police said.

Winnebago County District Attorney Christian Gossett said Officer Achterberg shot at Tucker 11 times, hitting him in the shoulder and leg.

Tucker drove off but was found in a shed by other officers. They administered first aid, but he later died from the gunshot wound in his shoulder.

Tucker's autopsy showed a variety of different drugs in his system, including cocaine and meth.

The two officers involved are still on administrative leave. They will not face criminal charges.
