WAUPACA COUNTY (NBC 26) — The Waupaca County Sheriff is requesting the Wisconsin Department of Justice offer a full review of the operations of the Sheriff's Office and the District Attorney's Office.
According to the statement from Sheriff Timothy Wilz, the request stems from a criminal trespassing case from September 2020.
Sheriff Wilz says before the report on the case was submitted to the District Attorney for consideration of prosecution, the report was reviewed for accuracy, as per policies of the Sheriff's Office. The Sheriff says the particular report was corrected, "to accurately reflect the intent and actions of the reporting officer in draft form before the distribution to the District Attorney's Office."
According to the Sheriff, the officer was made aware of the correction to the report and agreed with the correction.
The Sheriff said the District Attorney requested an investigation to review this matter and any Brady/Giglio issues. The Sheriff said an outside agency conducted an investigation and said there was "no willful deceit" or any other "improper purpose" in changing the report, and said there were no Brady/Giglio issues.
Sheriff Wilz said the Sheriff's Office is in the process of requesting the state DOJ to investigate.
