MADISON (NBC 26) — Six Wisconsinites have been charged in connection to the U.S. Capitol riot.
One of those include a West Allis man who will begin his 30-day sentence next week for his involvement in the riots last year. David Mish was charged with unlawful entry on restricted grounds and violent entry and disorderly conduct on the Capitol grounds.
Two other Wisconsin men charged with taking part in the riot, Michael Fitzgerald of Janesville and Joshua Munn of Melrose, have status conferences set later this month.
Additionally, according to the Associated Press, U.S. District Judge John Bates ordered 29-year-old Brandon Nelson of Madison and 24-year-old Abram Markofski of La Crosse each to serve two years on probation and pay $500 in restitution. He also fined Nelson $2,500 and Markofski $1,000.
The men pleaded guilty in September to a misdemeanor charge of parading, demonstrating, or picketing in a Capitol building. Prosecutors argued they each should spend two weeks in jail, but their attorneys argued they deserved probation since there’s no evidence they committed any acts of violence or destruction.
Both men appeared for a sentencing hearing by video in federal court in Washington, D.C., and said they were sorry, the Associated Press reports.
Marofski’s attorney, Jonas Bednarek, added that Marofski already has lost his job at Kwik Trip in La Crosse and the Army National Guard has started stripping him of his security clearances. Nelson’s attorney, Jessica Ettinger, said Nelson, a psychiatric technician at Mendota Mental Health Institute, is embarrassed and has cut “toxic politics” out of his life, according to a report from the AP.
In another Associated Press report, Kevin Loftus pleaded guilty to a misdemeanor charge related to the U.S. Capitol breach.
Loftus entered the plea to parading, demonstrating, or picketing in a Capitol building. The 53-year-old Eau Claire man appeared by video in U.S. District Court in Washington, D.C. after earlier reaching a plea deal with prosecutors.
The Associated Press reports the misdemeanor carries up to six months in prison, but the agreement does not recommend a sentence. The deal, however, requires that Loftus pay $500 in restitution to help pay for the estimated $1.5 million damage done to the Capitol during the Jan. 6 riot. Loftus is scheduled to be sentenced Jan. 31.
